Court Approves Class Action Suit Against SiriusXM

A U.S. District court has approved class action status for a lawsuit brought against SiriusXM by the Turtle's Flo & Eddie over payment of royalties for songs produced before 1972. Under the ruling, other artists whose music was recorded prior to 1972 can now join the suit to seek damages. U.S. District Judge Philip Gutierrez said, "a class action is superior to individual litigation to the fair and efficient adjudication of the present controversy."
In September, 2014, Gutierrez ruled, that under California state law, the New York-based satellite operator was liable for copyright infringement by airing the band's pre-1972 songs without paying royalties.
"Sirius XM treats every single owner of a pre-1972 song the same, namely it doesn't pay them, so it was appropriate for this court to grant class certification," said Flo & Eddie Inc. attorney Henry Gradstein. Flo & Eddie Inc. is headed by founding Turtles members Howard Kaylan and Mark Volman.
