FCC Media Bureau Adopts Consent Decree with Dickey

The FCC's Media Bureau has adopted a Consent Decree with Dickey Broadcasting Company and the Lewis W. Dickey, Sr. Irrevocable Children's Trust (trust or transferee). The decree resolves issues arising from the Bureau's review of applications for Commission consent of the proposed transfers of control of DBC (applications) from Lewis W. Dickey, Sr. (deceased) to the trust for WIFN-AM/Atlanta, WCNN-AM/North Atlanta and WFOM-AM/Marietta, GA. Licensee seeks nunc pro tunc grant of the applications, or retroactively.
While the agency said it anticipates the future grant of the applications, under the decree, the grant will not be nunc pro tunc. The decree resolves the Bureau's investigation of licensee's compliance and that the trust stipulate it violated the Commission's rules. The decree also requires, among other things, that Dickey Broadcasting make an $8,000 civil penalty payment to the U.S. Treasury and undertake a three-year compliance plan to prevent future similar violations.
