Beasley Enters into $15,000 Consent Decree with FCC

The FCC has adopted a Consent Decree resolving unauthorized pro forma assignments and transfers of various broadcast licenses held by Beasley Broadcast Group Inc. The company agreed to make a make a $15,000 civil penalty payment to the U.S. Treasury and undertake a three-year compliance plan to prevent future similar violations.
The issue involved transfer of applications between one subsidiary company to another, which Beasley sought to have granted nunc pro tunc, or retroactively, after they occurred on December 31, 2017. In December, parent company BBGI transfered licenses as part of an internal corporate restructuring. Then in January, it filed an application requesting nunc pro tunc grant of the transfers.
The FCC ruled that transfer of control of any corporation holding such permit or license to any entity without FCC permisssion is prohibited. Beasley had applied to transfer stations held by WDAS LLP, WKIS LLP, WPOW LLP, WQAM LLP and WXTU LLP from BBGI to BMGLL.
