Tenderfoot TV Suing Audacy's Cadence13 for Contract Breach
RADIO ONLINE | Sunday, September 3, 2023 |
Podcast studio Tenderfoot TV has filed a lawsuit against Audacy's Cadence13 alleging that Cadence13 has breached their long-term sales contract for ad sales on popular shows like "Up and Vanished," "To Live and Die in LA," "Rattled & Shook" and "Radio Rental." The suit was filed in the U.S. District Court in Los Angeles after Tenderfoot TV received notice from Audacy earlier in the month that they were "suspending further performance of C13's payment obligations." The disputed August payment amounts to $520,833.
According to court documents, the agreement between Cadence13 and Tenderfoot TV stipulates a minimum guarantee of $14 million over the initial two years of the contract, which began on January 1. Additionally, the minimum guarantee is set to increase to $21 million over the three-year term, extending through December, 2025. In addition to the overdue August payment, Tenderfoot TV is seeking interest, legal fees and unspecified damages as part of its legal action.
Neither Audacy nor Cadence13 has yet issued a response to the lawsuit.
